General Terms of Use

General Terms and Conditions for the use, ordering, and delivery of an online icon online ordering store ikonata.bg:

I. General provisions
Acceptance of these General Terms and Conditions is mandatory in order to use the services of the online store ikonata.bg, hereinafter referred to as the Website.
Their acceptance constitutes the conclusion of a contract between you, hereinafter referred to as the User, and ikonata.bg, hereinafter referred to as the Administrator, under which you have the right to use the Website’s services. These terms give you the right to use the Website’s services for non-commercial purposes.
At its discretion, the Administrator reserves the right to amend these General Terms and Conditions, with the amendments taking effect and becoming binding on all users from the moment they are published on the ikonata.bg website. By accepting these General Terms and Conditions, you also agree to any subsequent amendments made to them and undertake to comply with them.

II. Subject matter and scope of the General Terms and Conditions
(1) These General Terms and Conditions are available to every visitor, being published in a prominent place on ikonata.bg, and govern:
- the terms for using the website ikonata.bg by Users of the goods and services offered through it;
- the procedures, terms, and methods for carrying out purchase and sale transactions between the Administrator and Website Users, as well as their rights and obligations under the concluded transactions, delivery timeframes and methods, payment, and the procedure for returning or replacing purchased goods.
(2) Acceptance of the General Terms and Conditions by Website Users is a mandatory condition for concluding transactions and arranging delivery of the ordered products. If Users have not accepted the General Terms and Conditions, the Administrator is not obliged to enter into legal relations or conduct transactions with them.
(3) These General Terms and Conditions are accepted by checking the box “I have read and agree to the General Terms and Conditions of Use” during the registration or order placement procedure by Users and guests of the Website.
By checking the box, the User declares that they have read and accept the General Terms and Conditions, thereby making an electronic statement within the meaning of the Electronic Document and Electronic Signature Act.

III. General description of the Website and the services offered
The Website is an online store at the internet address ikonata.bg, through which Users can place online orders for goods. The goods offered on the Website by registered sellers are presented to Users with photographs and detailed descriptions of their characteristics and prices.
Through the Website, Users may register and create their own customer profile, which can be edited, or use the Website’s services as Guest Users without creating a customer profile.
Users may make payments in connection with concluded transactions using the available payment methods for the ordered products. They may receive up-to-date information about new goods and send electronic statements related to the concluded transactions. 

Based on contractual relationships with the specified courier companies, deliveries of ordered and available goods are made in accordance with the stated delivery terms. Additional fees may be charged to the stated delivery prices if the parcel exceeds 1 kg or if the customer requests delivery at a fixed time. For cash on delivery, a 1.2% commission fee is added to these prices; this fee is free of charge for customers and is borne by the seller (as stated in the “Delivery and Payment” section).
Payment for the selected goods in the online store ikonata.bg is made by cash on delivery, i.e. in cash upon delivery by the courier.

Any product purchased from our online icon store may be exchanged or returned upon presentation of a receipt within 14 days of the purchase date.
The goods that Users wish to return or exchange must be in excellent original condition and bear their original labels. If these conditions are not met and the goods are damaged, the sellers reserve the right not to exchange them, in accordance with the instructions and rights for returning goods provided by law.

IV. Registration on the Site
To be entitled to place orders for purchasing goods from the Site, the User must complete the electronic registration form. When completing it, the User must provide accurate information about their identity and the other data required in the form. The User guarantees that the information provided is complete, truthful, and accurate and will update it promptly if it changes.
By entering their details in the registration form and clicking the “I have read and agree to the General Terms of Use” button, the User declares that they have read these general terms, agree to them, and undertake to comply with them unconditionally.
The Administrator confirms the completed registration by sending a message to the email address provided by the User. A customer account is created for the User, and a contractual relationship arises between the User and the Administrator.
The Administrator has the right to require the User to identify themselves and verify the accuracy of the circumstances and personal data provided during registration.
If the Administrator discovers inaccurate data concerning a User, the Administrator has the right to terminate the User’s registration and access to their customer account.

V. Limitation of Liability
All goods offered by the Site are based on data and information received from the merchants/authors whose products are offered on the Site. Therefore, we cannot guarantee and are not responsible if the data posted on the Site is incomplete, outdated, or inaccurate. 

The website ikonite.bg shall not be liable if an ordered product is not delivered to the User by the relevant delivery service, or if the delivered product is not of the expected quality, due to reasons beyond the Administrator's control or that cannot be attributed to the Administrator.
The website ikonata.bg shall not be liable for consequences or any damages resulting from force majeure, unforeseen events, Internet problems, or technical or other reasons affecting access to, use of, or inability to access the Site.

The Administrator shall not be liable for damages arising from publications, opinions, and comments posted under products on the Site.
In the event that security measures are breached, resulting in the subsequent loss or dissemination of information, access to or restriction of access to information, or other similar consequences, the Administrator shall not be liable.
The Administrator shall not be liable for damages or consequences in the event of fraudulent identification by a third party impersonating the User. If they suspect that their customer account has been compromised, every User must immediately notify the Administrator.

VI. Confidentiality
The website ikonata.bg protects the personal data of Users provided when completing the electronic registration forms. The Administrator may use personal data solely for accepting and fulfilling orders or for contacting Users regarding issues related to an order. Personal data may be disclosed only when information is requested by government authorities or persons authorized by law. 

At the User's request, their customer account, together with all associated information, may be deleted from the database.
The Administrator takes the appropriate measures to protect personal data in accordance with the Personal Data Protection Act. 

By accepting the General Terms and Conditions, the User agrees that their personal data may be processed for the purposes of collecting statistical information about visits to the Site and preparing internal analyses and statistics.

You consent to receiving advertising messages by email, on your mobile phones, via push notifications, or as notifications published on the Platform. You agree that all agreements, notices, disclosures, and other correspondence that we provide to you electronically shall be deemed to have been made in writing. If at any time you decide that you do not wish to receive advertising messages by email, you may unsubscribe from receiving such messages by entering your telephone number or email address (with which you are registered on the Platform) and following the link ikonite.bg/otkaz, or by selecting the link in the email message. However, please note that some of these messages are necessary in connection with the execution of a purchase/sale order and that you cannot unsubscribe from such messages when placing an order or making a sale.

By accepting these General Terms and Conditions, the User agrees to receive commercial communications within the meaning of the Electronic Commerce Act.
 

VII. Purchasing

All purchases made through the Platform constitute an obligation on your part to purchase the item you ordered. If you are a buyer of a product and your request has been accepted by the seller, you are obliged to fulfill the terms of the transaction with the seller. In the case of products that are available for sale at other locations, sellers determine the online price themselves. 

VIII. Sales

As a registered member of the Platform, you may publish listings on it for the sale of items. You may offer for sale or sell only items that comply with applicable law. You must have the legal capacity to offer these items for sale or sell them in accordance with applicable law. The final price of an item includes all taxes and fees.

You are obliged to complete a sale for every request received from a buyer. You agree to contact the buyer and deliver the sold item to them in accordance with the terms and condition described in your listing.

IX. User Account and Obligations Related to Registration

When you register as a member of the Platform, you have been or will be required to provide certain information and register a username and password in order to use the Platform.
In connection with your registration as a member of the Platform:

-          You agree to immediately notify ikonata.bg of any unauthorized use of your password and username or any other breach of security. Under no circumstances shall ikonite.bg be liable for any losses, loss of profits, or any other damages arising from your disclosure of your username and/or password.

-          You will provide true, accurate, current, and complete information about yourself, as specified in the registration form.

-          You are responsible for maintaining the confidentiality of and restricting access to and use of your username and password, and are liable for any activity carried out through your user account.

Our goal is to ensure access to the website at all times; nevertheless, we reserve the right to discontinue its operation at any time and without notice. You agree that access to the services may be interrupted in order to make improvements to the website, perform scheduled maintenance, or for any other external reason beyond our control.
